Can You Trademark a Business Name Before Launch?
Yes. UAE trademark rules allow individuals and businesses to apply for trademark registration. The UAE Ministry of Economy and Tourism states that when an application is made in a personal name by an owner located in the UAE, a trade licence is not required. If the application is made in the name of a company or institution, the relevant trade licence is required. How to Register a Trademark in the UAE Before Launch
1. Choose a distinctive brand name. Avoid names that are generic, descriptive, misleading, offensive or confusingly similar to existing protected marks. UAE Federal Decree Law No. 36 of 2021 sets out marks that cannot be registered and defines the scope of a trademark.
2. Conduct a trademark search. Before investing in branding, check whether the proposed name or a similar mark has already been registered or applied for. The Ministry provides an official trademark inquiry service.
3. Decide who will own the trademark. If you are still pre launch, ownership should be planned carefully. A UAE based individual may apply in a personal name without a trade licence, while a company or institution applying as the owner needs the applicable commercial licence.
4. Prepare the application. The Ministry's current service information lists a copy of the trademark in JPEG format among the core requirements. Additional documents can apply depending on the applicant and whether an agent is used.
5. Submit the trademark application online. The Ministry reviews the application and communicates its decision. If accepted, the mark is published in the official trademark bulletin and a 30 day objection period applies before final registration.
6. Complete registration after the objection period. Once the required process is completed, the Ministry issues the trademark registration certificate.
What Should You Check Before Applying?
Do not check only the exact spelling of your proposed business name. Search for similar names, logos and marks in the same or related goods and services categories. Also check your intended domain name and major social media handles. A strong brand name should be distinctive, commercially usable and scalable across the UAE and future markets.
